TERMS OF USE AND CONDITIONS OF SALE
SANDS LUXURY TRADING L.L.C.
These Terms of Use and Conditions of Sale ("Terms") govern access to and use of www.sands-uae.com (the "Site") and all purchases made through or in connection with the Site.
The Site is operated by SANDS LUXURY TRADING L.L.C., a company licensed in Dubai, United Arab Emirates under Licence No. 1144576 ("SANDS Luxury", "Company", "we", "us" or "our").
By accessing the Site, creating an account, placing an order, making payment, or purchasing any product from SANDS Luxury, the customer ("Customer" or "you") confirms that they have read, understood and agreed to these Terms.
These Terms shall apply subject always to any mandatory rights available to consumers under applicable UAE law.
1- Use of the Site
SANDS Luxury grants users a limited, revocable, non-exclusive and non-transferable right to access and use the Site solely for lawful personal purposes.
Users shall not:
- a. use the Site for any unlawful, fraudulent or unauthorized purpose;
- b. copy, reproduce, modify, distribute, commercially exploit or create derivative works from any part of the Site without prior written authorization;
- c. interfere with the operation, security or integrity of the Site;
- d. introduce viruses, malicious code or other harmful material;
- e. use robots, spiders, scraping tools, automated systems or data-mining technologies without our prior written consent;
- f. attempt to gain unauthorized access to the Site, accounts, servers or systems; or
- g. use the Site or its contents in any manner that infringes the rights of SANDS Luxury or any third party.
We may restrict, suspend or terminate access to the Site where we reasonably consider that these Terms have been breached.
2- Independent Reseller Status
SANDS Luxury is an independent reseller of luxury products.
Unless expressly stated otherwise in writing, SANDS Luxury is not an authorized dealer, distributor, agent, representative, franchisee or affiliate of the brands whose products are displayed or sold through the Site.
The appearance of any trademark, trade name, logo or brand on the Site does not imply sponsorship, authorization, endorsement, affiliation or commercial association between SANDS Luxury and the relevant brand owner.
All third-party trademarks, logos and brand names remain the property of their respective owners and are used solely for the legitimate identification and description of genuine products offered for resale.
3- Intellectual Property
Except for third-party trademarks and materials belonging to their respective owners, all content appearing on the Site, including its layout, text, graphics, photographs, videos, databases, software, design and other materials, is owned by or licensed to SANDS Luxury.
No content may be reproduced, distributed, modified, published, commercially exploited or otherwise used without the prior written consent of SANDS Luxury or, where applicable, the relevant intellectual property owner.
4- Product Authenticity
SANDS Luxury represents that products offered for sale as authentic are sourced through suppliers and purchasing channels selected by SANDS Luxury and are sold by SANDS Luxury as genuine products.
SANDS Luxury is an independent reseller and any authentication undertaken by SANDS Luxury or its independent specialists does not constitute authentication, certification or endorsement by the original manufacturer unless expressly stated otherwise.
If a Customer raises a reasonable authenticity concern, SANDS Luxury shall be entitled to inspect the product and, where appropriate, submit it for independent professional authentication before determining the appropriate remedy.
Any product submitted for an authenticity claim must be returned in the same condition in which it was delivered, together with all accompanying packaging, accessories, certificates, tags and documentation, subject to mandatory UAE consumer rights.
A Customer shall not be entitled to a refund solely on the basis of an unsupported allegation of non-authenticity. SANDS Luxury may reasonably require supporting information and inspection of the relevant product before determining the claim.
Nothing in this section excludes any mandatory rights or remedies available under UAE law.
5- Product Condition and Sourcing
Unless expressly described otherwise on the relevant product page, products offered by SANDS Luxury are sold in the condition stated in the applicable product description.
Certain products may have been acquired by SANDS Luxury from independent suppliers, collectors, dealers, resellers, private sellers or other legitimate secondary-market sources and may therefore form part of the secondary or resale market even where the item itself has not previously been used.
The Customer acknowledges that packaging, protective wrapping, tags, certificates, date codes, serial-number presentation or other accessories may differ depending upon the source, year, market and manufacturer.
Such differences shall not, by themselves, constitute a defect or evidence of non-authenticity where the product otherwise conforms to its material description, subject always to applicable law.
6- Product Information and Images
SANDS Luxury takes reasonable steps to ensure that product descriptions, photographs, specifications and prices are accurate.
However, photographs are provided for illustrative purposes and colours or appearance may vary depending upon lighting, photography and the Customer's screen or device.
Minor variations that do not materially affect the identity, authenticity or essential characteristics of the product shall not constitute non-conformity, to the extent permitted by applicable law.
In the event of an obvious typographical, technical, pricing or inventory error, SANDS Luxury may correct the error and, where legally permitted, cancel the affected order and refund any amount actually received for that cancelled order.
7- Availability and Acceptance of Orders
Displaying a product on the Site does not constitute an irrevocable offer or guarantee of availability.
All orders are subject to availability, verification, payment clearance, fraud screening and final acceptance by SANDS Luxury.
SANDS Luxury reserves the right, where permitted by law, to refuse or cancel an order before dispatch, including where:
- a. the product is unavailable;
- b. an obvious pricing or description error has occurred;
- c. payment cannot be verified;
- d. fraud or unauthorized payment is reasonably suspected;
- e. delivery information is incomplete or inaccurate; or
- f. fulfilling the order would violate applicable law.
Where an order is cancelled after payment and no product has been supplied, amounts properly due for refund shall be returned in accordance with applicable law and the applicable payment-provider procedures.
8- Prices and Payment
Prices shall be those displayed or otherwise expressly agreed at the time the order is accepted, subject to correction of obvious errors where permitted by law.
The Customer is responsible for providing accurate billing, payment and contact information.
Orders may be subject to payment verification and anti-fraud checks before acceptance or dispatch.
The Customer represents that they are legally authorized to use the payment method submitted for the transaction.
9- Delivery
Any delivery date or timeframe provided by SANDS Luxury is an estimate unless expressly confirmed in writing as a guaranteed delivery date.
SANDS Luxury shall not be responsible, to the extent permitted by law, for delays caused by events outside its reasonable control, including courier delays, customs procedures, governmental action, import/export restrictions, adverse weather, transportation disruption or incorrect information supplied by the Customer.
The Customer must inspect the shipment promptly upon delivery and notify SANDS Luxury without unreasonable delay of any visible damage, shortage or incorrect item.
10- Returns, Exchanges and Defective Products
Where a Customer receives a defective, damaged or incorrect product, the Customer should notify SANDS Luxury as soon as reasonably practicable and, where applicable, within seven (7) days after receipt, without prejudice to any longer mandatory period or remedy provided under UAE law.
Any return must comply with the Company's applicable return procedures.
Unless the product is defective, incorrect or otherwise required to be accepted under mandatory law, returned products must ordinarily remain unused and in substantially the same condition in which they were supplied, together with the original packaging, tags, accessories, certificates and documentation.
Products that have been used, altered, damaged after delivery, resized, personalized, engraved or otherwise materially changed by the Customer may be refused for return or exchange to the extent permitted by applicable law.
Any refund, repair, replacement or exchange shall be subject to inspection and verification by SANDS Luxury and to mandatory UAE consumer-protection requirements.
11- Watches and Manufacturer Warranties
Unless expressly stated on the applicable product page or invoice, SANDS Luxury does not represent that it is an authorized service centre or authorized dealer of any watch manufacturer.
Any manufacturer warranty accompanying a product is subject exclusively to the terms imposed by the relevant manufacturer and may depend upon the product's original market, activation date, documentation and distribution channel.
Where SANDS Luxury expressly provides its own commercial warranty, that warranty shall be governed by the written terms accompanying the product and shall be separate from any mandatory statutory rights.
12- Customer Responsibilities
The Customer shall provide complete and accurate information when placing an order and shall cooperate reasonably with any verification, delivery, authentication or return process.
The Customer shall not knowingly submit false information, fraudulent claims, altered documents or misleading evidence in connection with a purchase, payment dispute, chargeback, return or authenticity claim.
SANDS Luxury reserves all rights and remedies available under UAE law in respect of fraudulent transactions, fraudulent chargebacks, abusive claims or other unlawful conduct.
13- Chargebacks and Payment Disputes
Before initiating a payment dispute or chargeback concerning an issue capable of being reasonably investigated or resolved directly, Customers are encouraged to contact SANDS Luxury and provide sufficient information for the matter to be reviewed.
Nothing in these Terms prevents a Customer from exercising any statutory or contractual right available through their bank, card issuer, payment provider or applicable law.
SANDS Luxury reserves the right to provide transaction records, delivery confirmation, communications, authentication evidence and other relevant documentation to banks, payment processors and competent authorities when reasonably necessary to defend a payment dispute, establish a transaction or protect its legitimate rights, subject to applicable data-protection laws.
14- Complaints and Dispute Resolution
The parties are encouraged to attempt in good faith to resolve any contractual or consumer dispute directly.
A Customer should first contact SANDS Luxury Customer Service and provide the relevant order information, photographs, documentation and reasonable details necessary to investigate the complaint.
Where the matter cannot be resolved directly, either party may refer the matter to the competent consumer-protection authority or pursue any remedy available under UAE law.
Nothing in these Terms shall restrict the jurisdiction or powers of Dubai Police, the Public Prosecution, consumer-protection authorities, regulatory authorities or any other competent governmental or judicial authority where jurisdiction exists under applicable law.
For the avoidance of doubt, ordinary disagreements concerning contractual performance, delivery, returns, product condition, warranties or other commercial matters shall be determined according to their actual legal nature under applicable UAE law. Nothing in these Terms shall convert a civil matter into a criminal matter or exclude criminal liability where the elements of an offence are established under applicable law.
15- Third-Party Websites
The Site may contain links to websites or services operated by third parties.
SANDS Luxury does not control and, to the extent permitted by law, accepts no responsibility for third-party websites, their content, availability, security, privacy policies or practices.
Access to third-party websites is at the Customer's own discretion and subject to the terms imposed by the relevant third party.
16- Disclaimer
The Site is provided on an "as available" basis.
To the maximum extent permitted by applicable law, SANDS Luxury does not guarantee that the Site will at all times operate uninterrupted, error-free or free from technical problems.
Nothing in these Terms excludes any warranty, obligation or consumer right that cannot lawfully be excluded or restricted.
17- Limitation of Liability
To the maximum extent permitted by applicable law, SANDS Luxury shall not be liable for indirect, incidental, special, exemplary, punitive or consequential losses, including loss of profit, loss of opportunity, loss of business or other indirect economic loss arising from use of the Site or a transaction with SANDS Luxury.
Where liability cannot lawfully be excluded, SANDS Luxury's liability shall be limited to the remedies and amounts required under applicable UAE law.
Nothing in these Terms shall exclude or restrict liability to the extent that such exclusion or restriction is prohibited by mandatory law.
18- Indemnification
To the extent permitted by applicable law, the Customer shall indemnify and hold harmless SANDS Luxury, its officers, employees and agents against third-party claims, losses, liabilities, damages and reasonable expenses arising directly from:
- a. the Customer's unlawful use of the Site;
- b. fraudulent or unauthorized conduct by the Customer;
- c. infringement of third-party rights by content submitted by the Customer; or
- d. a material breach of these Terms by the Customer.
This provision shall not require a consumer to indemnify SANDS Luxury for losses caused by SANDS Luxury's own breach of mandatory legal obligations.
19- User Content
Where the Customer voluntarily submits reviews, photographs, comments or other content for publication on the Site, the Customer confirms that they have the right to provide such content.
The Customer grants SANDS Luxury a non-exclusive, worldwide, royalty-free licence to reproduce, display and use such content in connection with the Site and SANDS Luxury's business and marketing activities, subject to applicable law.
SANDS Luxury may remove content that is unlawful, misleading, infringing, abusive or otherwise inconsistent with these Terms.
20- Fraud Prevention and Verification
SANDS Luxury may undertake reasonable identity, payment, transaction and fraud-prevention checks where necessary to protect the Company, Customers and payment systems.
Orders may be delayed, suspended or cancelled where additional verification is reasonably required or where fraud, unauthorized payment or unlawful activity is reasonably suspected.
Any personal information collected for such purposes shall be processed in accordance with applicable UAE data-protection laws and the Company's Privacy Policy.
21- Force Majeure
SANDS Luxury shall not be liable for delay or failure in performance caused by circumstances outside its reasonable control, including natural disasters, war, civil disturbance, governmental measures, sanctions, transportation interruption, customs delays, telecommunications failures, cyber incidents affecting third-party infrastructure, labour disruption or similar events.
This provision shall apply only to the extent permitted by mandatory law.
22- Changes to These Terms
SANDS Luxury may amend these Terms from time to time.
Any revised Terms shall become effective when published on the Site or from any later effective date specified therein.
Changes shall not retrospectively remove rights that have already accrued to a Customer under an existing transaction where such removal is prohibited by law.
23- Severability
If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary to make it enforceable, where legally permissible.
The remaining provisions shall continue in full force and effect.
24- No Waiver
Failure or delay by SANDS Luxury in exercising any right or remedy shall not constitute a waiver of that right or remedy.
Any waiver must be expressly made in writing by an authorized representative of SANDS Luxury.
25- Entire Agreement
These Terms, together with the applicable product description, invoice, order confirmation, Privacy Policy, Return Policy and any specific written terms expressly incorporated into the transaction, constitute the agreement governing the relevant purchase.
In the event of inconsistency, mandatory UAE law shall prevail.
26- Governing Law and Jurisdiction
These Terms and any transaction entered into with SANDS Luxury shall be governed by the applicable laws of the United Arab Emirates and the laws applicable in the Emirate of Dubai.
Subject to any mandatory jurisdiction provided by applicable law, the courts of Dubai shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms, the Site or any purchase from SANDS Luxury.
Nothing in this clause restricts the statutory powers or jurisdiction of any competent UAE governmental, regulatory, law-enforcement or judicial authority.

28- Acceptance
By accessing the Site or placing an order, the Customer acknowledges that they have had the opportunity to review these Terms.
By completing a purchase, the Customer agrees that the transaction shall be governed by these Terms, subject at all times to mandatory rights and obligations imposed by applicable UAE law.
